Please read these Terms of Use carefully before using the MotorBay platform. These terms apply to all visitors, users, and sellers who access or use our services.
1. Acceptance of terms
By accessing or using MotorBay ('the Platform'), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Platform. MotorBay reserves the right to update these terms at any time, and continued use of the Platform constitutes acceptance of any changes.
2. Use of the platform
MotorBay provides an online marketplace for individuals and businesses to advertise vehicles for sale or rent. You must be at least 18 years of age to use the Platform. You are responsible for ensuring that all information you provide is accurate, truthful, and up to date. You must not use the Platform for any unlawful purpose or in a way that infringes the rights of others.
3. Listings and content
When you post a vehicle listing, you grant MotorBay a non-exclusive licence to display and promote that listing on the Platform. You are solely responsible for the accuracy of your listing content. MotorBay reserves the right to remove any listing that violates these Terms or is otherwise deemed inappropriate, without notice.
4. Prohibited activities
You must not post fraudulent, misleading, or duplicate listings. You must not use the Platform to collect personal information from other users without their consent. Scraping, automated data collection, and any form of spam are strictly prohibited. Violations may result in immediate account suspension.
5. Transactions and liability
MotorBay is a marketplace platform only — we are not a party to any transaction between buyers and sellers. We do not guarantee the accuracy of listings, the quality of vehicles, or the conduct of any user. Users transact at their own risk, and MotorBay accepts no liability for any loss arising from transactions conducted through the Platform.
6. Intellectual property
All content on MotorBay — including logos, graphics, text, and design — is owned by or licensed to MotorBay and is protected by copyright law. You may not reproduce, distribute, or modify any Platform content without express written permission.
7. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.
8. Governing law
These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
